1. Acceptance of Terms

By purchasing or subscribing to any service offered by Marketing 247 (“we”, “us”, “our”), you (“Client”) agree to be bound by these Terms of Service.
These terms govern all WordPress maintenance, support and related digital services provided by Marketing 247.

2. Scope of Services

Marketing 247 provides WordPress maintenance services as outlined in the selected subscription package.
Services may include:

• WordPress core updates
• Plugin and theme updates
• Security monitoring
• Malware scanning
• Backups
• Uptime monitoring
• Limited support hours (where applicable)

Services are limited strictly to what is described in the selected package. Any additional work, development, redesign, content creation or third-party troubleshooting beyond routine update conflicts will be quoted separately.

3. Subscription & Billing

All maintenance plans operate on a recurring monthly subscription basis.
Payments are processed securely via PayFast
By subscribing, the Client authorises automated recurring billing.
Fees are charged in advance for each billing cycle.

4. Failed Payments

If payment fails, is reversed or charged back:

• Services may be suspended immediately.
• Access to maintenance services may be restricted.
• A reactivation fee may apply.
• Repeated payment failures may result in termination of services.

Marketing 247 reserves the right to recover any unpaid amounts.

5. Cancellation

Clients may cancel their subscription with 30 days’ written notice via email.
Cancellation will take effect at the end of the applicable billing cycle following notice.
No refunds are issued for partial months or unused service time.

6. Client Responsibilities

The Client agrees to:

• Provide accurate access credentials
• Maintain valid hosting and domain registration
• Ensure third-party licenses (themes, plugins, hosting) remain active
• Maintain legitimate software installations

Marketing 247 is not responsible for failures caused by expired licenses, unsupported themes, nulled plugins or third-party service interruptions.

7. Website Access & Credentials

The Client grants Marketing 247 authorised access to:

• WordPress admin
• Hosting environment

• FTP/SFTP

• Database access

Marketing 247 will use reasonable measures to secure such credentials but cannot guarantee absolute protection against cyber threats.

8. Limitation of Liability

Marketing 247 shall not be liable for:

• Loss of revenue
• Loss of data
• Business interruption
• Indirect or consequential damages
• Third-party plugin conflicts

• Hosting provider outages

• Cyber attacks beyond reasonable preventative measures

Total liability, if any, shall not exceed the total fees paid by the Client in the preceding three months.

9. No Guarantee of Rankings or Performance

Maintenance services focus on technical stability and security.
Marketing 247 does not guarantee:

• Search engine rankings
• Traffic increases
• Sales conversions
• Lead generation results

Unless separately contracted under a marketing agreement.

10. Suspension of Services

Marketing 247 reserves the right to suspend services if:

• Payments are overdue
• Client engages in illegal activity
• Website contains unlawful or harmful content
• Client breaches these Terms

Suspension does not waive payment obligations.

11. Intellectual Property

All intellectual property remains the property of the Client.
Marketing 247 retains ownership of internal systems, processes, documentation and proprietary monitoring tools used to deliver services.

12. Confidentiality

Both parties agree to maintain confidentiality regarding access credentials, business information and sensitive data shared during the engagement.

13. Data Protection (POPIA Compliance)

Marketing 247 processes personal information in accordance with applicable South African data protection laws.
Personal data is used strictly for service delivery, billing and communication.

14. Force Majeure

Marketing 247 shall not be held liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:

• Natural disasters
• Power outages
• Cyber attacks
• Hosting provider failure
• Government restrictions

15. Amendments

Marketing 247 reserves the right to amend these Terms at any time. Updated versions will be published on the website.
Continued use of our services constitutes acceptance of updated terms.

16. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
